Terms and Conditions

Definition: The Nursery is Parsons Green Nursery Limited (Parsons Green Nursery) Situated at 22 Cortayne Road, TheHume Centre, London SW6 3QA and 630 Fulham Road SW6 5RS. For the purpose of these terms andconditions and any other literature provided by the Nursery, the following phrases have meanings asfollows.

The Parents: The registered child’s, mother, father or legal Guardian.Parent: One of the registered child’s parents or their legal guardians. Chosen Representative: An individual authorised in writing by the parents to collect the registered child or act in loco parentis. “Full Time” Children that attend 5 full days “Fees in Lieu” (of notice) means fees in full for the term of notice at the rate that would have been applied had the child attended. “The Nursery”, Parsons Green Nursery inclusive of the staff, the premises and the company

Facilities Provided: Sessions available: Full Day (8am-6pm); Mornings (8am-1pm); Afternoons (1pm-6pm);

Registration: Upon registration of a child at Parsons Green Nursery, the Nursery will act in loco parentis during the hoursin which the child attends the Nursery. Registration constitutes acceptance of these terms and conditions.Children will not be accepted at the Nursery unless a parent and/or a legal guardian has signed theregistration form. The signature on file will stand in respect of all bookings made with regards to termsand conditions, of all activities delivered by the Nursery. Registration at Parsons Green Nursery constitutesacceptance of the nursery policies and procedures which can be requested from the office.

Curriculum and Extra Curricular Activities: The nursery endeavours to create a happy and safe environment for children staff and parents. Childrenwho attend full time will benefit from all events and all specialist classes on offer. While we endeavour tokeen timetables as consistent as possible changes to schedules, events and extra curricular activities maybe necessary and we will provide as much notice as possible of any changes to these. We cannot accommodate changes to children’s attendance based on extracurricular activities however parents areable to book adhoc sessions where availability allows.

Special Educational Needs and Disabilities (SEND): Our teachers are not generally qualified to make formal diagnosis of any medical or psychological conditions. However, many of our staff have experience working with children with SEND and will inform you if they have reason to believe your child may have additional needs. We will endeavour to make reasonable adjustments to provision for children who require additional support however there maybe occasions where the nursery is unable to provide the right environment or support for your child. In instances where there is no local authority support available in place by way of a SEN Statement or Education Health and Care Plan (EHCP) then the cost of an enhanced level of support (e.g. for a learning support assistant) will be borne by the parents.  Where required the process of submitting an application for an EHCP will be the parents responsibility, the nursery will provide as much support as possible to parents throughout the process. The layout, structure and facilities of the nursery means that the nursery may not be the right setting for all children. We reserve the right to request withdrawal of a child who needs support we are unable to offer or whose needs or behaviours impact the class consistently.

Registration and Nursery Deposit: By signing the Nursery registration form, parents and guardians agree that they will give three months’ notice in writing prior to the withdrawal of their child from the Nursery. A Nursery Deposit is payable on confirmation of your child’s place at the Nursery. Parsons Green Nursery will retain the full deposit if you decide not to take up the place. Please note that the deposit will only be refundable when a full three months’ notice is given to withdraw the child from the nursery (notice can only be given after the child has started at nursery), less any amount which may be outstanding and assuming that the parent and/or guardian has complied with terms and conditions. The deposit without interest will be returned one month after the child has left the Nursery. If a child is withdrawn or does not take up a place or otherwise cancels without giving three months’ notice in writing, three month’s fees are due in lieu of notice.

Notice of Withdrawal or attendance reduction: Please remember that a full three months’ notice is required for the withdrawal of a child from the Nursery or to reduce the number of sessions your child attends or three month’s fees will be due in lieu of notice. Notice must be emailed to admin@parsonsgreennursery.com. Notice to reduce attendance or leave can only be given once a child has started attending the nursery. The Nursery will issue confirmation of notice within two working days until this confirmation is issued notice will not be formally logged. Three months’ notice is also required should a parent wish to reduce the number of sessions their child attends per week, again notice of reduced attendance must be emailed, to the Nursery. Please note we are unable to reduce attendance temporarily, if you decide to give up some of your regular sessions, these will be re allocated and we cannot guarantee these will be available again if you wish to increase at a future date. Please note that it is not permitted for parents to swap their sessions or exchange them if a child is unable to attend due to sickness or absence for any other reason and no exceptions will be made. In addition, refunds will not be issued for sessions not attended for any other reason. 

Offers and Place Acceptance: Place offers, will be issued via email, in order to accept a place with us we must have received the following from you. A completed registration form, signed terms and conditions and payment of your £150 registration fee and £1000 deposit. Your secured place will be confirmed via email.

Official Start-Date and Deferral Requests: Parsons Green Nursery does not normally accept requests for deferral for your child to start at a later date that that set out on your offer email (Official Start Date). You will normally be expected to honour your child’s start date as confirmed upon registration (the ‘Original Start Date’), however, you may apply for a deferral of your original start date due to a situation that directly prevents your child from commencing as originally agreed for example serious illness of the child or an immediate family member (An immediate family is considered a parent or sibling not grandparents or other relatives). Any request for deferral should be made in writing at least 3 months in advance of the original start date. All deferral applications will be entirely at the discretion of the Nursery and, where granted, will not be permitted for more than a 6 month period. Where a deferral is granted, a fee of 50% of the ‘Deferred Attendance Period’ will be applicable. The Deferred Attendance Period is the defined as the period from and including the original start date to and including the new start date additional deferrals cannot be granted and medical certification will be necessary for all applications.

Payment of Nursery Fees: Any arrangement with a third party to pay Nursery fees, such as a grandparent, step-parent or any such person without parental responsibility does not release the parent from liability. If the third party defaults this does not affect these terms and conditions. The Nursery reserves the right to refuse payments from any third parties. Invoices will be sent directly to parents for forwarding onto third parties and any refunds if due will be issued to parents unless the Nursery is notified in writing. Nursery Fees are to be paid monthly in advance on or before the first day of each month. Such payment can be made by BACS or standing order. Payments must be made on time, in full and without deduction, the Nursery reserves the right to charge interest (at the relevant rate, provided for under the late payment of commercial debts (interest) Act 1998), administration, legal and collection costs in respect of late payment of fees. If fees have not been paid by the 5th working day of the month an additional late fee charge will be due of £10 per day, until funds are received in full. You agree that you are legally liable to pay us that surcharge. Extra session (adhoc) fees may be settles by BACS or in cash and are non-refundable after booking. The nursery operates a Christmas closure period of approximately 2 – 2 ½ weeks. Fees are calculated on an annual basis and take into consideration all days of closure, including, our Christmas Break, inset days and bank holidays.

Inset Days: The Nursery has three inset days per year, (one per term), these are essential to ensure staff training is kept up to date and that staff are informed of changes in legislation. Parsons Green Nursery reserves the right to change these days or add additional days and we will try to give you as much notice as possible of any changes. These days have been taken into account when calculating school fees and so are not refundable and cannot be exchanged.  

Absence: Parents are required to inform the nursery of their child’s absence no later than 9am on the day/morning of attendance or 1pm if attending the afternoon session. Holiday or absence due to sickness can be logged on the famly app.

Increase In Fees: Fees will be reviewed on an annual basis at a minimum, Parsons Green Nursery reserves the right to increase Nursery fees as and when necessary without prior notification although we will endeavour to give you as much notice as possible.

Waiting lists: We endeavour to place as many children on our waiting list as quickly as possible. However please note that joining our waiting list is no guarantee that we will be able to offer your child a nursery place. We endeavour to provide priority to full time children, those currently attending and siblings of children currently in attendance. Parents are requested to familiarise themselves with the nursery admissions policy when joining the waiting list. Please note sibling priority may not apply in circumstances where the nursery feels placement of a sibling would not be in the best interest of the child or the nursery is unable to meet the needs of that child.

Refunds and Cancellation Charges: No Refund of fees will be made for any period in which your child is absent due to sickness, holidays or any other reason. It is the policy of the Nursery, to charge for days that children are registered to attend the Nursery, regardless of weather, or if the Nursery is closed for events such as sports day or staff training. Fees will also be payable if the Nursery is closed for any other event beyond our reasonable control, such as weather conditions, health and safety concerns, lack of essential services, acts of terrorism, or any government or local authority action or recommendations which leads to closure or prevents normal access to or use of the business premises.

3 & 4 years old offer: Parsons Green Nursery does accept the 3 & 4-year-old government scheme. This is funding towards the cost of early years education and will help towards the fees for every child, commencing the term after (January, April or September) of their third birthday. The 3 & 4 year-old offer is not means tested and so accessible by all parents once they have provided a passport or birth certificate evidencing their childrens age. Your child’s monthly fees will be reduced by your child’s funding allocation the funded hours will be presented as nil on invoices and there will be an additional line item with additional charges for these hours. This is because the nursery does not offer a very basis level of childcare funded by the government scheme. Parsons Green Nursery will return details to Hammersmith and Fulham Council on a termly basis to request funding. Please note that parents remain responsible for fees should we not receive this funding or Parsons Green Nursery decides to withdraw from the scheme for any reason. Parents are required to sign the council application form and the nursery's 'agreement to additional charges' in order to apply. Additional Government funding schemes for children aged 2 and under: The Nursery may participate in additional government funding for children aged 2 and under. Please note that although we may offer some access to funding parents ultimately remain liable for the total value of children’s fees during their time with us. The nursery reserves the right to not offer funded places or to withdraw from the scheme entirely at any point without notice. Additional fees will always be due to cover the difference between funding allocated and the nursery fees for funded hours and parents will be expected to pay for any care exceeding the entitlement in full. We may offer a limited number of funded places and reserve the right to reject parents requests to access this. Parents who are accepted onto the scheme will need to sign a nursery agremeent letter outlining additional charges due. 

Collection of Children:You should inform us in advance if a chosen representative is to collect your child from the Nursery. The names of these individuals should be written on your childs registration form or provided by email or famly message to the nursery manager. Any individuals nominated for collection will needed to be added onto your child’s famly account as a contact by the parents, with collection permission and a clear colour photo of the individual. They will need to download the famly app to access their unique pin number which must be entered on collection or drop off. Each individual with collection rights must have and use their own pin numbers, sharing of pin numbers is strictly forbidden. Any individual collecting who are unknown to nursery staff may be asked to present photo ID in addition. Under no circumstances will a child be allowed to leave the premises unaccompanied or with any unauthorised person or with any person who we deem to be unfit to look after a child’s welfare and safety. If in doubt Parsons Green Nursery reserves the right to keep a child on the premises until confirmation from the parents has been obtained or the situation clarified. It is important for the children and the Nursery that children are collected promptly. If parents are late, they Nursery reserves the right to impose a minimum fine of £20. Children must be collected prior to closing at 6.00pm failure to collect by this time will be considered as late collection and parents may be subject to the fine of £20 for the first 15 minutes or part there of and an additional £15 per following 15 minutes or part thereof. We request that for the children’s benefit and for the smooth operation of the Nursery that you ensure your child is dropped off and collected from the Nursery within the time frames specified. This will usually be between 8am and 9am for morning and full day sessions, for collection between 12.45pm and 1pm for children who attend morning only or, 5pm – 6pm for afternoon collection. Children who attend afternoons only must arrive at 1pm. 

CCTV:Parsons Green Nursery operates close circuit television recording, this is for security purposes; footage will not be shared with parents or any third parties, except law enforcement officers if required. Footage may also be used for staff training purposes.

Dietary Requirements, Preferences and Allergies: Whilst Parsons Green Nursery will make every effort to facilitate a child’s specific dietary requirements, the Nursery shall not be held responsible at any time if it fails to meet the dietary specifications as directed by the parents. The Nursery cannot be held responsible if a child has an allergic reaction to either food or drink, which is unknown to Parsons Green Nursery and has not been notified in writing. If a child does require a specific diet for religious or other reasons, the Nursery must receive specification in writing prior to commencement at the Nursery, parents must inform us in writing if at any time their child’s dietary requirements change. Parsons Green Nursery has an onsite nutritionist who works directly with our food provider to ensure healthy, balanced meals which are familiar to the children are provided. In exceptional circumstances where Parsons Green Nursery cannot meet the specific dietary requirements of a child, parents may be asked to supply a packed lunch. 

Parsons Green Nursery always operates as a nut free nursery and may also place a ban on other items such as eggs according to the severity of any allergies of children in attendance at the time. Parents agree to observe all bans on specific food items as notified by the nursery head. 

Parent Conduct:Parents agree to treat all nursery staff with respect. Parents are expected to uphold the nursery Kindness code and follow the nursery visitor polices. Parents who fail to meet this condition maybe refused entry or asked to withdraw their children. Parents agree not to use mobile phones on the nursery premises

Non-Solicitation of Staff:Parents agree not to directly or indirectly canvas or solicit or endeavour to encourage any staff to leave the employment of Parsons Green Nursery. Should you employ one of our staff within one year of them leaving our employment to care for a child that is or has been registered with the Nursery, you will be liable to pay us an introduction fee of £3,000. If parents make arrangements directly with Nursery staff out of Nursery hours for babysitting, this is a private arrangement and the Nursery takes no responsibility for this. These arrangements are to be approved by the nursery manager. Parents are reminded that staff are not authorised to discuss any matter in relation to the nursery while not on duty. Staff who have left the employment of the nursery are not permitted to enter the building for collection or drop off of children. 

Termination and Suspension:Parsons Green Nursery reserves the right, to terminate or suspend a child’s place in the Nursery in the event that any fees remain unpaid or the parents show unacceptable behaviour or contravene these terms and conditions, or where Parsons Green Nursery is of the opinion that termination/suspension is reasonable or necessary in the interest of the Nursery. The refundable deposit will be returned in full, if all fees are up to date and all terms and conditions have been abided by.

Confidentiality: Parent’s consent to Parsons Green Nursery communicating with any other Nursery with which a parent proposes their child should attend about any matter concerning the child or payment of fees. Subject to your legal rights or any need to disclose information to a court of law or regulatory body you agree that terms and conditions shall be kept confidential between us. You agree that you shall not make disclosure about the running of the nursery or the relationship between you and the nursery to others, in person, in writing or online without express permission from the nursery. 

Photographs:Part of monitoring and tracking your child’s progress and development, photos and videos will be taken on a nursery iPad these maybe displayed around the nursery and posted on the internal news feed. Permission to use photographs of your children in the public domain will be sought separately.  

Entrance and Buggies:Buggies are not to be left inside the Nursery building under any circumstances; they can be left in the buggy shed at parent’s risk. Parsons Green Nursery will not accept responsibility for any item left by parents in the buggy shed that is lost, stolen or damaged. We kindly ask parents to ensure no allergens are left in children’s buggy’s to avoid accidental access by children.

Outings:As part of the Nursery Curriculum, the children will be taken on supervised visits to local parks, they may also be taken on educational trips in the local community. Registration at the nursery constitutes permission for these outings.

Health and Safety:A child should not be brought into Nursery if he or she has suffered from vomiting sickness or diarrhoea in the last 48 hours. If your child has suffered a temperature, rash or any infectious illness, he or she must not return to Nursery until they have been symptom free for a full nursery day. If a child becomes ill or has an accident during the day, the parent will be contacted to that subsequent action can be decided. In an emergency an ambulance will be called and a senior member of staff will go with the child, they will stay with them and act in loco parentis until the parent arrives. The nursery operates exclusion periods for conjunctivitis, hand foot and mouth and nits beyond what is set out by the NHS. This is in protection of the nursery community. A nursery environment is not suitable for an unwell child and we reserve the right to refuse entry to any child we feel is not fit to be at nursery regardless of if they meet exclusion criteria.

Accidents:while the nursery endeavours to minimise all accidents and incidents however accidents do occur at nursery and the nursery cannot accept liability for any accidental injury.

Medication and Emergencies: If your child has been prescribed oral antibiotics, they cannot attend Nursery for the first 24 hours of treatment. If a child is receiving regular medication which will need to be administered during they time at Nursery, the medication must be prescribed by a doctor, clearly marked with a label stating the child’s name the dosage, the expiry date of the medication and the prescribing Doctor’s name and telephone number. Calpol and other over the counter medications cannot be administered (save for immediate first aid due to an extremely high temperature) unless a doctor’s note is provided with instructions on administration. No medication will be administered without a parent’s prior consent in writing, other than immediate first aid. Parents must notify the Nursery in writing, with Doctors letter if requested, of allergies their child suffers from. If you child requires an epi pen the nursery will need two epi pens to be kept at nursery it is parents responsibility to monitor the expiry date of epi pens and provide a replacement in good time. Children who require epi pens and do not have an epi pen at nursery will be refused entry. Please observe the Nursery’s policy on Epipens. Parents consent to the nursery acting in loco parentis in the event of emergency the nursery. Parents consent to the nurseries right to call an ambulance for their child in the event of emergency and escort your child to hospital in the ambulance. Any decisions about the child’s care and treatment will be made by medical professionals at the hospital until your arrival. Parents give permission for children to have sun cream, face paint and plasters applied except where you have informed the nursery that your child suffers from an allergy.

GDPR: In instances where we feel it necessary for the welfare of the child  The Nursery may make reasonable disclosure of information about your family or child to nursery staff or other educational establishments, regulatory bodies or the police.

Disclosures: Parents agree to inform us or any known or suspected medical conditions, developmental delays, disabilities, learning difficulties that may affect your child.  Parents agree to inform the nursery of any court orders than may impact your child of affect their emotional wellbeing or home life. Parents must at all times ensure the nursery holds on file the correct address and contact details for both parents. This can be updated on children’s famly profile by nursery management must also be informed in writing of any changes.

Advancement of Terms & Conditions: Parsons Green Nursery reserves the right to amend at any time these terms and conditions and vary or cease to provide any of the facilities being provided. Generally speaking, terms and conditions will be updated annually and available to view on our website under the parent login tab.

Clarification and Agreement to Specific Terms:

Acceptance Fee/ Deposit:  Parsons Green Nursery charges a £1000 Acceptance fee/deposit on acceptance of a place. I/We understand that this nursery deposit is not refundable if I do not take up my secured place for any reason including changes to personal circumstances.  If you provide less than three months notice of not taking up your secured place three months fees based on the agreed attendance pattern on starting will be due minus the deposit sum. The Acceptance Fee/Deposit is only refunded after children have left the nursery Children must have started and given three months written notice.

Deferrals: I understand places are not transferable between sites and that deferrals are generally not accepted. Exceptions may be considered In cases where there are serious and direct extenuating circumstances. E.g. For children with medical conditions preventing them from attending nursery on their agreed start date. In these instances a maximum of 6 months deferral may be granted charged at a 50% fee rate. In these instances a medical certificate will be required confirming the length of the deferral required up to a maximum of 6 months. The nursery offers a maximum number of deferrals per year and reserves the right to reject all deferral requests.

Notice of Withdrawal or Reduction: I understand that three months is required to withdraw from the nursery or reduce the number of sessions my child attends. I understand that I cannot reduce sessions on a temporary basis and that once notice has been given on specific sessions these will be offered to the next child on the waiting list. I understand notice to withdraw or reduce attendance can only be given once my child has started attending the nursery.
